1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Rummage City (the "Service"), operated by Rummage City ("Rummage City," "we," "us," or "our"). By creating an account, posting a listing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Rummage City is a listing platform for rummage, yard, garage, and estate sales, and for the organized city-wide events that group them. Some listings are submitted directly by users; others are gathered from public third-party sources and, in every case, held for review before appearing publicly (see Section 6).

3. Accounts

You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms.

4. User Content

When you submit a sale listing, event, description, or image ("User Content"), you grant Rummage City a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Service. You represent that you have the right to submit it and that it does not infringe any third party's rights.

You are solely responsible for the accuracy of your listings, including address, dates, and times. Rummage City does not verify listing accuracy and is not responsible for a sale that is mislisted, cancelled, or does not occur as posted.

5. Prohibited Conduct

You agree not to:

Post false, fraudulent, or misleading listings;
Harass, threaten, or impersonate another person;
Upload content that infringes another party's intellectual property or privacy rights;
Interfere with or disrupt the Service's operation, including its servers or networks;
Attempt to gain unauthorized access to any account, system, or data on the Service.

5.1 Automated Access & Scraping

Except for the operation of well-behaved, publicly-documented search engine crawlers, you may not access, collect, copy, "scrape," harvest, index, or store any content or data from the Service using a bot, spider, script, crawler, browser-automation tool, or any other automated means, without our prior written permission. You may not circumvent, disable, or interfere with any rate-limiting, access-control, or bot-detection measure we use to protect the Service.

Violating this section is a material breach of these Terms. Rather than assess damages, our primary remedy is technical and immediate: we may block, rate-limit, filter, or otherwise deny access to any IP address, account, network, or client associated with unauthorized automated activity, without prior notice, for as long as we consider necessary to protect the Service.

This does not limit any other legal or equitable remedy available to us, including termination of your account and, where warranted, legal action.

6. Third-Party & Aggregated Content

Some listings on the Service originate from publicly available third-party sources. Where we know the original source, we record and may display it. We do not claim ownership of third-party-sourced listings, do not guarantee their accuracy, and their inclusion does not imply endorsement by, or affiliation with, the original source. Every such listing is held in a pending state and reviewed before it becomes visible on the Service.

7. Intellectual Property

The Service's design, branding, logos, and underlying software are owned by Rummage City or its licensors and are protected by intellectual property law. Nothing in these Terms grants you any right to use our trademarks or branding without prior written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any listing is accurate or current.

9. Limitation of Liability

To the fullest extent permitted by law, Rummage City and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Rummage City from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service at any time.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
